If you can't delete photos on iphone directly, they were synced and need to be unsynced from the same computer. So connect back to computer and go to photos tab. Uncheck checkbox and hit apply.

First you will need to plug your iPod into your computer. Then you need to find the Photos tab. De-select any synced photo libraries or folders.Hit sync. It will ask if you want remove them. Say yes. This should free up some space.

unfortunately there is no way you can recover the deleted photos.

Check your Trash - may be setup to hold on disk until emptied. Will give option to delete or recover.
