As a 14 year veteran, Certified Master Spa Technician, and Factory authorized warranty tech for nearly every manufacturer of either spas or components, as well as one of the only infra red sauna control re-manufacturers in the US, I would recommend that you ONLY use a circuit which is protected by a GFCI breaker.
There is NEVER a reason that you CANNOT use a GFCI breaker for a spa or sauna circuit. In fact, the National Electric Code requires it in the case of a spa, and the same for a sauna which utilizes water for steam.

26 Installing two pole GFI breaker
I'm not clear on why you can't use a GFI Breaker. Has someone said this to you, or have you tried using a GFI and it didn't work? Does the heater run off 120 v or 240 v?
