Did you replace or resurface rotors also? You might have glazed rotors and pads can't grip rotors as they're supposed to. You should have rotors replaced or resurfaced (if they're within safety specs)
No never got the rotors done as mechanic thought they where OK. Would rotor damage not give the fault all the time rather than intermittently like i am experiencing? Sometimes it will not happen at all then other times more often i was thinking more a restriction in fluid or air if that makes any sense.

Let me get this straight... you had the brake pads replaced, but the rotors were not 'RESURFACED' or 'MACHINED'??... If this is the case, then the new brake pads will take longer to 'SEAT' to the rotors. SEAT - wear into/match the mating surface. If the surface area of the new pads don't MATCH the rotors, then FULL contact of the frictional surfaces have not happend... resulting in POOR braking system performance. ALWAYS have the rotors resurfaced/machined when replacing pads -- this ensures the new pads SEAT with the rotors.
