Change the fluid every 2 years-- you won't have that problem

This has been a common problems on these models, even with new clutches. May also be more noticeable on inclines. Have your mechanic check the transmission mount. When they wear they cause the transmission to slightly move, which sometimes pulls on the shift linkage. The other thing you mechanic needs to check is to see if your transmission needs new shift synchronizers. Replacing them would be a transmission rebuild.

Why do you want to add it? Wipe the dipstick on clean white paper towel or cloth. If there are no leaks and the colour is still fairly bright it should be ok. If there are no leaks and the transmission is slipping it needs to go to a dealer or tranny shop.

check your transmission fluid level. it is likely that you have a failed transmission.

Are you sure you use the right type of fluid, and have you let it warm up and checked the level with the engine running?
I would only use the recommended oil suggested by BMW.

Try manually shifting it?
Also, is there any chance you disconnected a wire or hose to the transmission valve body when you had the pan off?
Or any chance you got some dirt inside?

Re-check the transmission fluid level. It's possible that the level has "settled" due to the work that you did on it, and may be low now, even though it appeared normal when first topped off.

it must be something to do with electronic control to gearbox ecu wireing i assume the replacement gearbox came with tourqe convertor a diagnostic check might be best option

The 3 series does not have a dipstick in the engine compartment. It is similar to a manual transmission and should have filler/level plug on the side of the gearbox casing.

Check the trans cool hoses from the trans to the radiator.
Try and find where the fluid is leaking from.
Let me know what you find.

Check the transmission release bearing and the gearing of the transmission check if you need to replace the release bearing.
