The brake light switch is adjustable. Before adjusting it, make sure the brake pedal is in it's full up position. Sometimes a weak return spring will be the cause.

You didn't list the year/make/model/engine size But as a general rule, the brake lights staying on is an indication that the brake switch (located on the brake pedal assembly, probably close to the firewall) is either in need of adjustment or replacement. Some vehicles also have a brake relay that could be sticking. Check your owner's manual for the location of this relay.

I can imagine that your vehicle very well could be equipped with daytime running lights. On many vehicles, setting the parking brake before starting the engine will make the daytime running lights stay off. They will only stay off as long as the parking brake is not released.
Check the tail light bulbs, One may be shorted & feeding voltage to brake lights. Check sockets & wiring. Yes, the brake light switch is above the foot brake.
