this is caused by a piston in the transmission that has a crack in it once it warms up the crack seals and operates normally.being cold the crack opens up allowing fluid to flow past it. take to trans shop as soon as you can, will be minimum repair if it has not caused further damage in the transmission.

A couple of possibilities: Sun gear is cracked or gear is stripped or your valve body has a sliver of aluminum or dirt in it allowing valve not to move.

If you drive it easy and don't take off lie a rabbit and drive like grandma it would be possible to miss clutch wearing out. As far as gearbox damage is concerned it depends on how long you let it go before fixing. If you have to shove it into gear you can damage syncros and bend shift forks. And if it goes long enough that would ruin the gears and bearings with enough metal in the oil that could wear shaft and bearings. You will get clutch chatter and your performance will be poor mileage will drop. And the clutch chatter can cause the flywheel to be damaged and need to be surfaced, it could burn up the slave cylinder, so it is not wise to let it go, as it will cost more money.

it must be something to do with electronic control to gearbox ecu wireing i assume the replacement gearbox came with tourqe convertor a diagnostic check might be best option

You might need a new clutch attachment kit... there is a clip that usually goes bad and causes the cable to float.(No tension)
