Hi there.
Your fryer may have problem in cutting off the heating element power (electric fryer) or burner flame (gas fryer) for temperature regulation which is thermostat's main function.Thermostat is replaceable, you have to identify the manufacturer of your fryer to get the exact component.

Replacing the tank isn't cost effective. I am the only one I know that repairs fryer tanks. Most cannot be repaired(welded) successfully. If you got 8 years out of it..that's not bad. Time for a new one.

Our Rival deep fryer stopped working one night...just after christmas, I figured with the holidays I would wait and contact them after... I had forgotten to until today when my husband reminded me to... So after phoning them, and speaking with Alex, I now have a free replacement cord being sent, and the deep fryer was a few days over the warranty...

You should determine how many amps the unit is pulling, you will need an ammeter to do this. Continuity through the internal circuit breaker does not determine the current being pulled by fryer only that it can pull current. If the fryer is pulling more than 50 amps the problem will be in the fryer, if it is less than 50 and the breaker trips you could have a faulty breaker.
