I've been presented a contract for 3 yrs at a set monthly rate. the vendor has the right to raise the fee up to 5%/yr a cancellation penalty of 50% of the total if cancel in 3 years.one or the other?

You can’t change the number and email address. This has to be done by a phone service like AT&T, T-Mobile, etc., or a company that is contracting with them that sells their service, like WalMart, Target, etc. They would assign a mobile phone number and use whatever email address you may already have from your Internet Service Provider , e.g., Cox, Comcast, etc.
If you have a device using your son’s email address and a phone number, different from what you want, you may have to cancel the contract (assuming you have one) with them in order to get a new number assigned by a different company. Cancelling the contract may still hold you responsible to pay the fees for the entire contract (e.g., 2-years) you currently have, or you may have a penalty to pay. Check with you current phone service provider, e.g., AT&T. Make sure to ask about penalties and fees if you cancel your current contract. They may be willing to roll over your current contract to a new one, and not charge you penalties. Ask !

If you reside where there is a public library, I suggest you ask one of the librarians there about an organization or organizations in South Africa where you can file a consumer complaint regarding the cell phone contract and the early cancellation fee.

Personal opinion: You may just have to resign yourself to keeping Vodacom as your provider and change to a new one when your Vodacom contract is completed. By that time, you will be able to investigate all your choices and understand which company provides the best service and contracts for customers.

The Term of the subscription is the length of time that You have selected, which term will be automatically renewed unless You modify Your account or cancel. If You cancel Your subscription, You are NOT eligible for a prorated refund of any portion of the subscription fee paid for the then-current subscription period. If You have pre-paid for a certain period of services (for example if You paid a lump sum for 6 months of service), You are NOT eligible for a prorated refund of any portion of the pre-paid amount UPON cancellation.

This is their terms. You can cancel it, but you will still be charged the remaining term of your contract either way.

How to cancel you membership;

  1. Proceed to SpeedDate.com and log in to view your home screen.
  2. Click the "More" link in the upper-right corner of the page, and then click "Account Settings."
  3. Scroll to the bottom of the page, and click the "Deactivate" link next to "Deactivate My Account."
  4. Click the "Deactivate My Account" button.
  5. Click a radio button to indicate why you want to delete your SpeedDate account.
  6. Click the "Deactivate Account" button.
  7. Type a statement to explain what you would improve about the SpeedDate service.

Hi there,
The contract that was set between you and 3 was for the usage of the telephone company's services, the handset was given to you, to use for the duration of the contract, which is locked to 3.

If you have completed your contract, it only means the contract with 3 for the services is finished and that the phone still is locked to 3.
Check the 3 website, it says "If you want to unlock your handset, a fee may apply. The amount of the fee will depend upon whether you are a Pre-Paid or Post-Paid customer and what plan you are currently on".
So legally, 3 can charge you if you want to unlock your phone, even if it is out of contract, since you have agreed to the contract and T&A set out within.
It's up to you to either pay 3's agreed unlocking price for the handset or go to another mobile phone repair shop and try to get a cheaper price.
Unfortunately 3 seems to be the only service provider that is a bit extreme and unfair with their post paid handsets. I know that from previous experience, other service providers gladly unlock their handsets for free after the contract is finished or even during the course of the contract (usually free after 6 months through the contract).

if what you are saying is that you have to calculate 7% monthly from 100 $ this means exactly $7 for each month ..so you have to multiply 7 for one month with 360 months and the result will be $2520 for all 360 ...unless it has some penalties to be calculated or something like that ..If the problem that you describe is accurate this is the answer..

If you have signed a contract that was made between you and your service provider then you have binded an agreement that you will pay them for the services they provide. The contract should have terms and conditions that you have agreed to, if a set payment per month was required under the contract that means you have to carry it out. Therefore yes, your service provider is lawfully allowed to demand that you pay the remainder of your contract.

Ring your service provider and ask if you can pay an exit fee which is usually just a price set by your service provider multiplied by the remaining months on your contract. You still have to pay money, but its usually cheaper than what you would've been paying if you still carried on with your contract.

I suggest to you before you sign a contract to read through it carefully and consider if you can oblige with the terms and conditions. Many people forget to do this and end up with hefty fees and bad credit ratings.

If they never gave you a written disclaimer about equipment that is incompatible with their service then tell them that your contract is not valid and you will not pay them. Because of your specific issue you are not actually receiving the service that they are getting your money for. You're paying full price just for the signal to be sent to you.
If they again refuse to cancel the service without penalty or alter it to be compatible with your TV then contact the Better Business Bureau and file a complaint.
