Unfortunately, you're not asking the right people. This site (Fixya) isn't a manufacturer's site, and has nothing to do with any product sales. The software isn't "our product". You can try contacting the
software manufacturer. You'll need to register with them and submit a ticket describing your issue, but then maybe you'll be able to get a hold of someone there who can do something. You could also try contacting Fry's and plead your case, but with software it's difficult. Once software is opened most vendors won't take it back unless it's defective, and then all they do is give you a new copy of the same thing.
You can't really blame the salesperson. There's so much software and so many versions that they can't know everything about all of them. About all you can do is read the information on the box and try to figure out if it will do what you need and if your system will run it, or research which version of a program you need ahead of time so that you know what to grab at the store.
