The problem is similar to when you hover a tablet pen over the tablet and you move your mouse around, but it happens even without using the tablet and it happens almost half of the time. I've fixed it by pressing the pen onto the tablet, but I'd like to know how to stop this from happening in the first place.

Have you tried replacing the Pen battery? Maybe it died.

Try putting a new battery in it. Mine was having the same sort of problems, and they were pretty much entirely fixed by a new battery.
SOURCE: My Tablet pen wont release, it acts like im clicking and holding
I'm just gonna pass on a email from Tech Support I recieved.
"It sounds as though your pen has pressure in proximity. This is present when the tip sensor of your pen is stuck down causing the pen to think that it’s clicking before it’s even touching anything. What you may want to try would be to remove the nib from the tip end of the pen, it pulls straight out with a pair or tweezers or your teeth, and leave that out overnight with the pen left on its side. Place the nib back in the morning and if the issue persists then you may have a defective pen tip."
The rest consists of personal info and warranty advice so I'll leave it there.
SOURCE: How do you put the pen in "Mouse mode" on a Genius?
Go to the tablets properties and there is a screen that says PEN MODE with a dot you click next to it and under it there is a MOUSE MODE with the same selector you click, then you apply it and it will be back to either mouse or pen mode.
hope i helped
