Create and sign in to the google account.

You can do a complete reset if you want and have no other option(this will erase all your data). To do this follow these steps.
Scroll to wipe data/factory reset using the volume buttons. to select it press the home button
You will need a Google account to use the phone. It works like an iTunes account for an iPhone.
It should give you the option to create one, but if not just make one on a computer (any Google account will work, ie Gmail, Youtube, Google Docs, etc).

Unfortunately there is a problem in some google play services on some devices. Google won't acknowledge the problem and it is very frustrating, the best advice I can give you is take back to where you got it because it effects functionality of your phone and hence isn't doing what they said it would. I know it's a rough answer (the same thing had happened to my sisters s3) your not alone. Take it back as soon as suppliers start complaining they will fix it, having said that it is Google's problem so maybe complain there is you can be bothered going through the process. Just remember your phone doesn't do what the seller said it would and you are entitled to fix or replace under Australian law.

In settings there should be option to factory reset, but there also should be an accounts field where you could remove the account and add yours, but to get rid of anything left behind from previous user the factory reset would be better option.
