If you are 100% sure the device was stolen you need to report it to the proper authorities, and that's all you can really do, considering the warranty doesn't cover loss or theft. Oh, and next time don't get it stolen. ;)
If it was reported lost or stolen, this is for a reason. You should contact Amazon to return the device to its proper owner, and the police to bust the person that sells "lost or stolen" goods. You might even get your money back.
