Sounds like the problem is with the water heater itself . Iwould check both elements. Call a good plumber.
Although the tank was new, I did replaced both wather heating elements and is been working great since then ..

Will the water stay hot in the kitchen sink? Try to isolate the problem. If it is happening at all hot water locations, then it will be related to your water heater. If just in the shower then it is related to the mix of water ratio coming out of the shower hear. If its only the shower, then you are getting too much cold and not enough hot through the pipes. This can be very simple to fix by replacing the handle going to the shower. If this does not work then you may have a problem in the hot water pipes. After you isolate the problem, please post another question here.
This could be many things, none of which are good. First, try turning up the heat on the water heater, only one notch per day as water can get scolding hot. If that does not work, you could have very hard water which has allowed sediment to fill your tank (doubtful if you bought it new in Nov 08). Your incoming water pressure could be too high not allowing enough hot water in, depending on how pipes are ran. Lastly, your diverter in your shower may not be working, but you said you already changed that out
This may sound silly, but are you sure the hot/cold are not backwards in the shower?

I have the 40 gal Whirlpool electric .. same problem here, after two minutes (not even 10 gallons) the water gets cold or barely warm with the shower valve all the way to hot ..

Not sure if this is where you reply, but first thanks for answering Bati99 second.... Yes the water in the kitchen still stays hot. The tech that came out also thought it was the hot/cold ratio but i had a plumber replace the handle and all the stuff in it and the water temperature is still dropping after 2/3 minutes. thats why i wrote here cause i'm kinda at my wits end with trying to solve this problem. whirlpool's techs (which are actually Sears) suggested it might also be that and that is why i had the handle the cartridge and balancing thingy within the handle replaced. i just wanna be able to take more than one shower without the water getting cold. Any other suggestions, i'd truly appreciate it, thanks in advance.
i have turned up the dial on the water heater, and your right it does get scolding. it makes the hot last longer before it starts getting cooler but definitely not hot enough for 2 complete/3 showers. yes the tank is barely 5 months old. Yes the diverter & all parts in it were changed out. not sure about the water pressure...it was fine for the hot water heater that i replaced, i actually just replaced it because it was 10 years old, it wasn't giving me any problems, it worked like a charm, i just didn't want to come home to a basement full of water with it being older. the hot & cold i don't believe are backward only because it does get hotter when i turn the handle that way, it just doesn't last.
Same problem with Whirlpool gas water heater. Brand new, but the water gets colder within minutes of continuous use. I have to keep turning up hot water when I shower. My previous water heater never did that.
My suspicion is that either Whirlpool water heater does not kick on the burner until temperature drops too much, or its burner BTU is not what it claims and it is unable to heat up water as quickly as it need. Unfortunately, I could not find any information to make any adjustment. Increasing the temperature set point does not help because it only changes the starting temperature, 3-5 minutes into the shower, water gets cooler.
Very disappointed in the Whirlpool brand. Probably will be staying away from anything Whirlpool for a long while...
