Your watch is 12 hours out of step.
The date changes every second time the hour hand passes 12 O'clock.
Your watches' second pass is at midday instead of midnight, so to make it operate correctly, you need to wind it on 12 hours. The date will then change at midnight.

there is so many kind of fossil bi tic there is one that when you push the button the digitd moves in different ways, there are with animations, with different colors of dial that you will not notice that it is changing... which one among of the big tic is your watch. but if it is does nothing, your watch probably had a problem. it might be the button, or you had to reset it. or its battery had to be replace by new one... you had to bring it from the shopo that you had purchased it for its service warranty. Make sure of course that the stem is pushed all the way in to start the watch. If it is all the way in then your battery must be dead. You can look around the edge of the back for a lifting area and use a pocketknife to pry the back off, the problem is with new watches you may need a jewelers watch press to get back back on. Also be aware some watches have screw off backs and some have screws those should go to your local jeweler...actually because its a new watch i would return it or at least take it to a watch repairman or a jeweler! Hope this helps!

Inside the case back on my JR-7855 is a label with the steps to take to change the batteries. The sticker says to short the pad marked "S1" with the pad marked "+". Keep doing it quickly, then check the watch face. You got it right when the seconds start to change on the face.
Here is a view at the inside of the watch. The two points you are looking for are highlighted in red.

You don't say which model watch you have.
If you go to Fossil.com, at the bottom of the screen you will see a list, click on "customer care" and under "product info" you will see "watch instructions".
Go through the list of illustrations to find yours and download.

Is there a rubber gasket
Yes. In your watch, as with most wristwatches that have a snap-fit case back, there's a thin neoprene gasket that sits either in a groove cast into the watch case or around the part of the case back that snaps into the watch case. Either way, the gasket is designed to further reduce the amount of moisture that can wick in between the tiny gap between the case back and the watch body.
As a matter of procedure, for maximum water resistance, this gasket is supposed to be changed every time the watch is opened (for example, when the battery is replaced). As a practical matter, however, I have often reused a gasket if it has not been distorted from pressure or mis-installation (lots of these gaskets end up crimped or pinched when they slip out of position as the case back is pressed into place). Does it provide reduced water resistance? Possibly, though moisture more often enters a watch fastest through the opening for the stem used to set the time. Leaving the back gasket out entirely, however, definitely creates an easy path for sweat and moisture to enter a watch.

Need to know what battery
Hello:
The battery number will be imprinted on the dead battery (for that watch it's most likely 379), however, I wouldn't recommend replacing a battery on a Fossil yourself. They are notorious for their back being incredibly difficult to remove and put back on and if you're not a professional, you will most likely break the crystal in the process. If it's a screw-back (and you can tell because it will have six rectangular shaped notches around the edge of the back) you won't be able to get it off unless you have a case wrench and a case vise. Take it to a jeweler and have them change it for you.
