Have you checked the bulbs and fuses? The fuse box for them is under the bonnet, usually near the battery. The lid normally just unclips. Try fuses 13, (brake lights), 22 (right), and 23 (left) for the tail lights. Always replace fuses with the same colour and rating.
I think on your model the bulbs are fairly simple to get to. Fold the small cover inside the boot out of the way. The bulb board is simply clipped into place. Bend the two clips inwards and wriggle it out past the boot liner. The bulbs are just a small turn Anti-clockwise and It slides out.
I've attached links to a fuse box diagram and a YouTube video for the rear lights. https://fusesdiagram.com/volkswagen/fuses-and-relay-volkswagen-passat-b5.html

This 2005 VW Jetta SE was involved in a motor Vehicle Accident and ... I had troubles with my vauxhall zafira 1 ...
Aug 10, 2006 - i was driving into my apartment complex, and i put my car in park ... He checked the shift lock, fuses, brake light switch, computer stuff ... Automatic ShifterStuck in Park, waldo358, Volkswagen Passat, 1, 12-27-2007 05:23 PM.
The problem is likely in the headlight switch--either a failing contact or perhaps an issue with the connector at the switch. see wiring diagram below.
the next move i would take is to check the brake lamp switch it is normally located on the brake pedal shaft itself and is a simple on off switch. Here is a helpful link
check brake light fuse. if ok. check to make sure you have dcv at brake pedal brake light switch mounted on brake pedal. if there is voltage present depress brake pedal and dcv shold be present on other terminal of brake pedal switch. if not replace brake pedal switch
There is no fuse for the third brake light that I know of, it is wired into the main brake light wiring on most cars anyway. Probably the bulb is blown.
I had EXACTLY the same problem with a friends car i was doing work on.
Your problem is almost certainly a faulty brake light switch. This is a
common fault and brings on the dash lights you describe. The switch is
located just above the brake pedal and is easy to fit. If you can get
the OBD codes read...My guess is it will show up this switch as faulty.
Good luck
