The car will automatically be failed if the check engine light is on, Clearing the codes and taking it in to smog may not work because the cat monitor and others need to complete and pass, disconnecting the battery will erase all monitor information. It's not 40 drive cycles but maybe two or so after the repair, usually driving the car on both highway and stop and go city traffic with two drive cyles will complete the monitors, depending on what state you live in it may not be necessary to pass all monitors so ask your local smog station how many and which ones must pass.
