Warranty question
Alot is based on the amount of wear on a paticular part, according with the mileage of the car. Like in a transmission, if the internal parts have alot of scoring, burnt clutches, and so on, that may show signs of abuse, depending on the mileage. Dealerships see parts go out at all different mileage and all types of driving conditions. So they have a bit of knowledge of how the vehicle has been driven, according to the amount of wear and damage a certain part has to it. Most of it is a judgement call on there end.

So how can we help? Didn't you test drive it before purchase? Check the owners manual for possible adjustments you can make to the seat and steering column positions. Some vehicles allow adjustment of the pedals as well. PS, I'm 6'2" and not European and that's average for my country.

My brand new 2009 Tucson has the same problem.

The possible CAUSES of the problem you describe are NUMEROUS!.. You may have what the industry calls a 'LEMON.' There is a LEMON law in every state. Sinse it's a 2009 model, keep at them (dealership). Warranty procedures APPLY! You may not like it, but you are covered under WARRANTY!.. I'm sorry, but under the warranty agreements between Hyundai Motor America and the Dealerships, you are relegated to KEEP AT them. The most difficult problems/malfunctions to diagnose are those which DON'T STAY BROKEN! Tell you what, since you posted your problem here, you'll have to do some homework yourself (become a Hyundai Certified Technician).. then you'll see how DIFFICULT the diagnosis can be. Walk a mile in the technician's shoes! Sometimes the problem can simply be a resistive/poor ground
circuit, OR, could be potentially a multitude of different problems. Take/tow the vehicle into a Hyundai Service Center (dealership), Insist they find out what the problem is!... Then you'll have the option of having them buy it back under the "Lemon Law.'
Needs a free english owner's manual
I would think you could get the English version by simply contacting your local dealership manager & get their Parts Department to order you a copy.
2017 Hyundai Tuscon drivers seat mechanism will not work for reclining seat. I need this to help ease getting in and out. Is this something I can fix myself?
The mechanism of a reclining driver's seat in a car can be complex, and it may require specialized tools and knowledge to diagnose and fix the problem. Depending on the cause of the issue, it may be possible for you to fix it yourself if you have the necessary skills and tools, but if you are not experienced with automotive repairs, it may be best to take the vehicle to a professional mechanic.
Before attempting any repairs, you should consult the owner's manual for your vehicle to understand the seat mechanism and any safety precautions you should take. If the problem is related to a broken part or a loose connection, you may be able to fix it by yourself with some basic tools.
However, if the issue is more complex or requires a replacement part, it may be best to take your vehicle to a professional mechanic or an authorized Hyundai dealership for repair. They will have the expertise and experience to diagnose the problem and repair the seat mechanism correctly and safely.
